Dep. Janovsky was called out to a neighbor dispute in which one neighbor was moving limerock from the county road onto his property to form a driveway. Dep. Janovsky was asked by the complainant to take an incident report but did not. He told the complainant it was not a Sheriff's Office problem. He was very short toward the complainant, displaying an uncaring attitude. Dep. Janovsky refused to take a report as requested by the complainant, thereby failing to execute the duties and responsiblities of his position properly.

Dep. Janovsky was dispatched to a criminal mischief call with a suspect in the area. The suspect abandoned his vehicle after allegedly destroying a power transformer by shooting at it. Dep. Janovsky did not thoroughly investigate the incident, and did not impound the vehicle which had been left abandoned on a public roadway. Violation of General Order 42.2, Sec. III: Criminal Investigations Operations.

Dep. Janovsky is alleged to have kicked a suspect in the face with his foot as the suspect was lying on the ground in the custody of two other deputies. The investigation revealed sufficient evidence to support the allegation of Dep. Janovsky giving a single kick to the left side of Mr. Fisher's (suspect) head.
